Movacars Distribution Inc. respects your privacy. This Notice explains the personal information we collect, how we use and share it, and the rights you have.
Movacars Distribution Inc. ("Movacars," "we," "us") respects your privacy. This Notice explains the personal information we collect, how we use and share it, and the rights you have under Florida law, the laws of other U.S. states with comprehensive privacy statutes, and applicable federal law.
1. Scope
This Notice applies to personal information we collect through our website, mobile applications, dispatch system, driver and partner portals, APIs, and other technology services (collectively, the "Platform"), and through our offline interactions with you.
2. Categories of Personal Information We Collect
- Identifiers — name, postal address, telephone number, email address, account credentials, IP address.
- Government-issued identifiers (drivers, vehicle owners) — driver's license number, vehicle title and registration information, social security number where lawfully required for tax reporting or background checks.
- Commercial information — Delivery Requests, transactions, fees, ratings.
- Geolocation and telematics (drivers, vehicles) — vehicle location, route, speed, harsh-braking and other safety events captured by our telematics system while a vehicle is in the Movacars operating fleet.
- Internet activity — device information, browser type, pages visited, referring URL, cookies and similar identifiers (see our Cookie Policy).
- Professional information (drivers, vehicle owners) — driving history, background-check results obtained under an FCRA-compliant workflow, insurance information.
- Communications — emails, SMS messages, support tickets, and recorded calls (where lawful and disclosed).
3. How We Use Personal Information
We use personal information to:
- Operate the Platform, dispatch Delivery Requests, and complete deliveries.
- Verify identity, eligibility, and qualifications of drivers and vehicle owners.
- Perform FCRA-compliant background checks where required.
- Manage insurance, safety, and incident response.
- Communicate with you about your account, our services, and operational matters (including SMS where you have consented).
- Bill, collect, and report payments and earnings; issue IRS Forms 1099 where required.
- Comply with legal obligations and respond to lawful requests.
- Detect, prevent, and address fraud, security, and abuse.
- Improve the Platform and develop new services.
4. How We Share Personal Information
- Service providers — background-check vendors, insurance carriers, payment processors, telematics providers, technology vendors, and professional advisors, bound by contractual confidentiality and use limitations.
- Business customers — limited delivery-related information necessary to fulfill a Delivery Request (e.g., driver first name, vehicle, ETA, proof of delivery).
- Drivers and vehicle owners — limited information necessary to dispatch and complete a Delivery Request.
- Legal and safety — government authorities, law enforcement, regulators, and other parties where required by law, to defend our rights, or to protect the safety of any person.
- Corporate transactions — successors, affiliates, or acquirers in connection with a merger, acquisition, financing, or sale of assets, subject to this Notice.
Movacars does not sell personal information, and does not share personal information for cross-context behavioral advertising, in each case as those terms are defined under the California Consumer Privacy Act and analogous state laws.
5. Telematics & Driver Privacy
While a vehicle is enrolled in the Movacars operating fleet, the vehicle is equipped with a telematics system that records location, mileage, diagnostic codes, and driver-behavior events. Telematics data is collected for safety, operational efficiency, dispatch, claims, and compliance purposes. We do not use telematics data for any purpose unrelated to operating the fleet. Drivers should not use the assigned vehicle for personal trips while enrolled; personal location data is therefore not expected to be captured. 7. Your Rights
Depending on where you reside, you may have the right to:
- Know — what personal information we have collected about you.
- Access / Portability — receive a copy of personal information in a portable format.
- Correct — request correction of inaccurate information.
- Delete — request deletion, subject to legal exceptions.
- Opt out — of sale or sharing for cross-context behavioral advertising (note: Movacars does not engage in these practices).
- Limit use of sensitive personal information — where applicable.
- Non-discrimination — Movacars will not retaliate against you for exercising your rights.
How to exercise your rights: email privacy@movacars.com or write to the address at the end of this Notice. We may need to verify your identity before responding. You may use an authorized agent where permitted by law. We will respond within the time required by applicable law (generally 45 days, extendable once where permitted).
8. Florida Digital Bill of Rights
If you are a Florida consumer and Movacars is subject to the Florida Digital Bill of Rights (Fla. Stat. § 501.701 et seq.) at the time of your request, you may exercise the rights set out above. Florida consumers may also opt out of the processing of sensitive data and of profiling that produces legal or similarly significant effects.
9. Children
The Platform is not directed to children under sixteen (16). Movacars does not knowingly collect personal information from children under sixteen. If you believe a child has provided personal information, contact us so we can delete it.
10. Data Retention
We retain personal information for as long as needed to provide the Platform, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data category and are set in our internal Data Retention & Destruction Policy.
11. Security
We implement administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is perfectly secure. Report suspected security incidents to security@movacars.com.
12. International Transfers
Movacars operates in the United States. If you access the Platform from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data-protection laws than your jurisdiction.
13. Changes to This Notice
We may update this Notice from time to time. Material changes will be communicated by reasonable means. The "Effective Date" above will reflect the latest version.
