Driver Terms
Summary of the Movacars Driver Services Agreement. Drivers are independent contractors. Florida intrastate operations.
This Driver Terms page summarizes the terms by which an independent professional driver ("Driver") performs last-mile delivery services for Movacars Distribution Inc. The binding instrument is the executed Driver Services Agreement. Where this summary conflicts with the executed Agreement, the Agreement controls.
1. Independent Contractor — Not an Employee
Drivers engaged through Movacars are independent contractors, not employees. Movacars does not pay wages, salary, overtime, or employee benefits. The Driver controls the means and methods of performing services and is free to perform similar services for other customers, including Movacars's competitors. Movacars does not withhold federal, state, or local taxes from Service Compensation and will issue an IRS Form 1099 where required by law.
2. Engagement
The Driver performs Delivery Services for Movacars using an Assigned Vehicle (allocated from the Movacars fleet) and the Movacars dispatch Platform. Each Delivery Request routed through the Platform may be accepted or declined by the Driver. The Driver may log out of the Platform at any time.
3. Eligibility
- Minimum age 21.
- Valid driver's license (Florida-issued unless otherwise approved).
- Driving record meeting Movacars standards.
- Successful completion of an FCRA-compliant background check.
- Completion of Movacars onboarding and acknowledgment of the Movacars Code of Conduct and policy framework.
- No appearance on any U.S. government list of prohibited or restricted persons.
- Compliance with all applicable federal, state, and local laws.
4. Assigned Vehicle
Movacars assigns a vehicle from the Movacars-controlled fleet to the Driver for the performance of Delivery Services. Movacars retains the right to reassign the Driver to a different vehicle. The Driver shall operate the Assigned Vehicle only in furtherance of Movacars Delivery Services. Personal use is not permitted while the vehicle is engaged in Movacars operations.
5. Service Access Fee & Service Compensation
The Driver pays Movacars a weekly Service Access Fee in consideration of the Assigned Vehicle and Platform access. The Driver receives Service Compensation on a per-delivery, per-route, and/or per-mile basis as set out in Exhibit B of the executed Agreement. Net statements and payment cadence are set in the Agreement.
6. Driver Responsibilities
- Operate the Assigned Vehicle safely and lawfully.
- Comply with the Movacars Code of Conduct, Acceptable Use Policy, Acceptable Cargo Policy, Drug & Alcohol Policy, Hours of Service & Fatigue Policy, and other applicable policies.
- Report incidents, accidents, breakdowns, citations, license changes, and material adverse events promptly in accordance with the Accident & Incident Response Policy.
- Use Movacars telematics; do not disable or interfere with Movacars-installed equipment.
- Treat customers, recipients, vehicle owners, and Movacars personnel with respect.
- Maintain professional appearance and conduct while representing the Movacars network in the field.
7. Prohibited Conduct
Drivers shall not, among other things, transport passengers in the Assigned Vehicle, transport hazardous materials or other prohibited cargo, operate while impaired or fatigued, allow unauthorized persons to operate the vehicle, or use the vehicle outside the Movacars Florida intrastate service area. 8. Background Checks & Driving Records
By engaging with Movacars, the Driver consents to background checks and driving-record reviews performed under an FCRA-compliant workflow. The Driver may request a copy of the report and has the right to dispute inaccuracies under the FCRA. See our Privacy Notice.
9. Insurance
Insurance coverage on the Assigned Vehicle is provided through the Movacars commercial program. Drivers are not third-party beneficiaries except as expressly stated. Drivers should evaluate occupational accident or other personal coverage as appropriate to their independent contractor status.
10. Term & Termination
The Driver Services Agreement is a term-of-engagement agreement that continues until terminated by either party in accordance with its notice provisions. Movacars may deactivate Drivers for violations of the Code of Conduct, safety events, or other material breach, in accordance with the deactivation procedures set out in the Agreement and applicable policies.
11. Arbitration; Class & Jury Waivers; 30-Day Opt-Out
The Driver Services Agreement contains a binding individual arbitration provision (FAA-anchored), with class-action and jury waivers. The Driver has a thirty (30) day right to opt out of arbitration after first accepting the Agreement, by following the opt-out instructions in the Agreement. Small-claims and injunctive carve-outs apply as stated in the Agreement.
12. Independent Contractor Acknowledgment
The Driver acknowledges the independent contractor relationship and the right to set hours, accept or decline assignments, and perform services for other companies. Nothing in the Agreement creates an employment, partnership, joint venture, or agency relationship.
13. Governing Law
The Agreement is governed by Florida law and the Federal Arbitration Act, with the venue and arbitration terms set in the Agreement.
