Acceptable Use Policy
Conduct and content not permitted on the Movacars Distribution platform, website, dispatch system, and APIs.
This Acceptable Use Policy ("AUP") sets out conduct and content that is not permitted on the Movacars Distribution platform, website, mobile applications, dispatch system, portals, and APIs (collectively, the "Platform"). The AUP is incorporated into our Terms of Use.
1. General Conduct
You may not:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
- Violate any third party's privacy, intellectual property, or other legal rights.
- Submit false, misleading, or fraudulent Delivery Requests, vehicle information, identity information, or insurance information.
- Impersonate any person or entity or misrepresent your affiliation.
- Harass, threaten, defame, or discriminate against any other person on or off the Platform.
- Bypass, disable, or interfere with safety, security, dispatch, or compliance features.
2. Cargo Restrictions
The following items may not be shipped through the Platform:
- Hazardous materials as defined under 49 C.F.R. § 172.101 and applicable Florida law — including explosives, flammable liquids and solids, oxidizers, toxic substances, radioactive materials, and corrosives.
- Firearms, ammunition, and weapons, except where pre-approved in writing under a special carriage arrangement.
- Controlled substances, except where lawfully prescribed and shipped by an authorized party with proper documentation.
- Live animals and plants subject to USDA APHIS controls, except under written arrangement.
- Human remains, organs, or biological specimens, except under written arrangement.
- Stolen property or contraband.
- Currency, bullion, negotiable instruments, jewelry, and high-value items above declared limits, except under written arrangement and additional insurance.
- Items prohibited by federal, state, or local law in either the origin or destination jurisdiction.
Movacars may refuse, return, or surrender to authorities any shipment that violates this section.
3. Passengers
The Platform is for cargo delivery only. No passengers may be transported in any participating vehicle while the vehicle is engaged in Movacars operations.
4. Vehicle Use
Drivers and Authorized Operators may not:
- Use the assigned vehicle for personal purposes while it is engaged in Movacars operations.
- Operate the vehicle outside Movacars's Florida intrastate service area.
- Modify the vehicle, disable telematics, or tamper with Movacars-installed equipment.
- Allow any unapproved person to operate the vehicle.
- Operate the vehicle while impaired by alcohol, controlled substances, or fatigue, in violation of the Movacars Drug & Alcohol Policy and Hours of Service & Fatigue Policy.
5. Platform & Technology
You may not:
- Reverse engineer, decompile, or attempt to derive source code from any Movacars software.
- Scrape, crawl, or harvest data from the Platform.
- Use bots, scripts, or automated tools without express written permission.
- Introduce malware, viruses, or other harmful code.
- Interfere with the integrity or performance of the Platform.
- Access accounts or data of other users without authorization.
6. Messaging
You may not use Movacars-provided communications channels to send unsolicited commercial messages or messages prohibited under the Telephone Consumer Protection Act, CAN-SPAM Act, or any other applicable communications law.
7. Reporting Violations
Report suspected violations of this AUP, including illegal cargo, safety concerns, or driver misconduct, to ethics@movacars.com or via the Movacars Compliance channel. Good-faith reports are protected from retaliation under our Code of Conduct.
8. Enforcement
Movacars reserves the right to investigate suspected violations and to suspend, terminate, or refuse service to anyone who violates this AUP, with or without notice. Violations may also be reported to law-enforcement or regulatory authorities.
